1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB) via the online shop www.panthera-automotive.com operated by Panthera Automotive GmbH (hereinafter “we” or “Panthera Automotive”).
We do not accept any deviating terms and conditions of the customer unless we have expressly agreed to their validity in writing.

2. Conclusion of contract

(1) The presentation of our products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
(2) By clicking the button “Buy now” the customer makes a binding offer to purchase the goods contained in the shopping cart.
(3) After submitting the order, the customer will automatically receive an email confirming receipt of the order. This confirmation of receipt does not constitute acceptance of the offer. The contract is only concluded upon a separate order confirmation or the dispatch of the goods.
(4) We do not permanently store the contract text. The customer can print the order data immediately after completion or save it locally.

3. Prices and shipping costs

(1) All prices are quoted in euros (€) and include VAT, unless otherwise stated.
(2) In addition to the stated prices, we charge shipping costs. These will be clearly communicated to the customer during the ordering process.
(3) For deliveries outside the EU (e.g. Switzerland, UK), additional customs duties, taxes or import charges may apply, which are to be borne by the customer.

4. Payment methods

We offer the following payment options:
PayPal, credit card, Klarna, Sofortüberweisung, Apple Pay, prepayment and Shopify Payments.
We reserve the right to exclude certain payment methods in individual cases.

5. Delivery and shipping

(1) Delivery is made worldwide via DHL, DPD or UPS, unless otherwise stated.
(2) Unless otherwise specified in the item description, the goods will be delivered within 2 to 5 working days after receipt of payment.
(3) If an item is not available at short notice, we will inform the customer immediately by email.
(4) Deliveries abroad may take longer; any delays due to customs clearance are beyond our control.

6. Assembly and workshop services

(1) In addition to physical products, we also offer assembly and installation services in our shop in our tuning center in Konstanz.
(2) When booking such services via the online shop, the appointment will be agreed individually.
(3) The customer is obliged to hand over the vehicle in a technically safe condition.
(4) Installation work will be carried out exclusively by our specialist personnel in accordance with applicable standards.
(5) We assume no liability for improper assembly, use or subsequent manipulation by third parties.

7. Retention of title

The goods remain our property until full payment has been made.

8. Right of withdrawal for consumers

Cancellation policy

Right of withdrawal:
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period shall be fourteen days from the day on which you or a third party designated by you takes possession of the goods.

by means of a clear statement (e.g. by e-mail) of your decision to withdraw from this contract.

Consequences of revocation:
If you cancel the contract, we will reimburse you all payments, including delivery costs (except for additional costs resulting from your choice of a type of delivery other than the standard delivery offered by us), promptly and at the latest within fourteen days from the date of receipt of your cancellation.
For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise.

We may refuse to refund until we have received the goods back or you have provided evidence that you have returned the goods.
You must return the goods to us immediately and in any event no later than fourteen days after notification of the cancellation.
You shall bear the direct costs of returning the goods.

Exclusion of the right of withdrawal:
The right of withdrawal does not apply to contracts for the delivery of goods,

• which are manufactured according to customer specifications or are clearly tailored to personal needs,

• or with software optimizations that have already been individually programmed for the vehicle.

9. Warranty

The statutory warranty rights according to §§ 434 ff. BGB apply.
The customer is obliged to report obvious defects in writing within 7 days of receipt of the goods.
In the event of a justified complaint, we will, at our discretion, repair or replace the goods.
If the subsequent performance fails, the customer may reduce the purchase price or withdraw from the contract.

10. Liability

(1) We are liable without limitation for intent, gross negligence, and injury to life, body or health.
(2) In the case of slight negligence, we shall only be liable for breach of a material contractual obligation (cardinal obligation) and only for the damage typical for the contract and foreseeable.
(3) Any further liability is excluded.
(4) We assume no liability for damage caused by improper installation, use or modifications by third parties .
(5) Liability under the Product Liability Act remains unaffected.

11. Warranty

We do not provide any warranty beyond the statutory warranty unless this is expressly stated for the product.

12. Data protection

Personal data is processed exclusively within the framework of the applicable data protection regulations (GDPR).

13. Applicable Law & Place of Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers residing outside Germany, German law applies, unless mandatory consumer protection provisions of the respective country conflict with this.
The place of jurisdiction is Konstanz, as far as legally permissible.

14. Final provisions

Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
Changes or additions to these Terms and Conditions must be made in writing.
